What is it?

Legal help for private disputes

It finances legal advice, lawyer, court, expert or mediation costs when you need to defend your rights.

Mandatory?

No, but useful before a dispute

It is not mandatory in Switzerland. It must be taken out before the dispute, because already known or foreseeable conflicts are excluded.

Key point

The covered area makes all the difference

Lease, work, consumer matters, neighborhood, internet or insurance: each policy precisely defines what is covered, limited or excluded.

What is private legal protection for?

Private legal protection applies when you need to assert your rights or defend yourself in everyday life. Depending on the policy, it may cover legal advice, lawyer fees, court costs, expert costs, mediation and sometimes costs owed to the opposing party.

It does not solve the problem for you, but it prevents a dispute with a property manager, employer, neighbor, seller or insurer from first becoming a budget problem.

Before a dispute, check four points

1Area

Le type de litige doit être expressément couvert par les CGA.

2Waiting period

Some areas often wait a few months before becoming active.

3Limit

Amounts per case can vary greatly depending on the plan and country.

4Lawyer

Free choice often exists subject to conditions and prior validation.

Common pitfalls we clarify

Legal protection is very useful if chosen before the dispute and if the areas important to you are actually covered.

Pre-existing disputeA conflict already born, announced or foreseeable before subscription is generally excluded.
Waiting periodOften around a few months, sometimes up to 6 or 12 months depending on the area.
Lawyer mandated too quicklyYou must contact the insurer before incurring costs, otherwise coverage may be refused.
Sensitive exclusionsDivorce, inheritance, tax, fines, intentional offences or professional activity are often excluded or limited.

I already have this policy, how can I cancel or switch insurer?

First compare waiting periods, limits, covered areas and rules for choosing a lawyer. If you switch, avoid any interruption: a new policy may not immediately take over all rights, especially for lease, work or real estate.

Private, circulation or combined?

Private legal protection covers everyday disputes. Traffic legal protection covers disputes linked to mobility: accident, license withdrawal, purchase, leasing or vehicle repair. A combined plan may be more coherent if you drive, rent a home, work as an employee and make many purchases or online procedures.

Free choice of lawyer: watch the conditions

Many cases start with the insurer’s internal lawyers. Free choice of an external lawyer is often possible in case of judicial or administrative proceedings, or in case of conflict of interest, but it may be subject to validation. Fees, quotes, limits and recognized lawyers must therefore be checked before mandating someone.

Who is it particularly useful for?

It is relevant for tenants dealing with a property manager, employees exposed to a work dispute, families signing many contracts, owners concerned by neighborhood or housing issues, and people who often buy online. It also complements some covers such as private liability insurance, which compensates damage but does not always finance the defense of your own rights.
