What is it?

Help to defend your rights

It covers legal advice, lawyer fees, proceedings, expert reports or mediation when a covered dispute affects your activity.

Mandatory?

No, but very useful as soon as you sign contracts

It is not generally mandatory, but it secures SMEs exposed to clients, suppliers, employees, landlords and authorities.

Key point

It does not replace professional liability

Liability insurance compensates a third party when your liability is engaged. Legal protection mainly finances the defence of your rights and your dispute costs.

  1. By trade Modules Employment, tax, contracts, debt recovery
  2. Parameter Limits Per dispute and per year
  3. Base Legal costs Lawyer, expert, court

Complements liability; does not pay damage you cause.

What is business legal protection for?

Being right is not always enough. A disputed invoice, employment conflict, complicated commercial lease or failing supplier can quickly cost more in time and legal fees than the initial amount in dispute.

Business legal protection provides access to legal specialists and then covers necessary costs when the case is covered: lawyer, proceedings, court, expert report, mediation, party costs or debt collection depending on the modules selected.

The right package depends on your likely disputes

Contracts + Staff + Premises + Receivables + Business modules

An SME that sells services, employs staff and rents premises does not have the same needs as a company with tenders, vehicles, subcontractors or intellectual property.

Free choice of lawyer: how does it work?

In Switzerland, the Insurance Contract Act provides for the free choice of lawyer when judicial or administrative proceedings are initiated, or when there is a conflict of interest with the insurer. In practice, you generally need to report the case before appointing a lawyer and obtain a cost guarantee.

Many policies start with the insurer's internal legal service. This is useful for resolving a simple dispute quickly, but you should check when an external lawyer becomes possible, how fees are approved and what happens if the limit is reached.

Common pitfalls

Legal protection is chosen as much by its exclusions as by its covered areas.

Existing disputeA conflict that already exists or is foreseeable before taking out the policy is generally excluded.
Waiting periodSome areas are only activated after a waiting period.
Case with no chance of successThe insurer may limit its intervention if the case appears lost from the outset.
Forgotten modulesClients, suppliers, debt collection, tax or intellectual property may require an extension.

I already have this policy. How can I cancel or change insurer?

Before switching, check the expiry date, cancellation period, already reported cases, waiting periods in the new policy and the modules actually carried over. A dispute whose cause predates the new policy may remain excluded, even if it becomes visible later.

Legal protection, professional liability and D&O: do not confuse them

These policies can complement each other, but they do not pay the same costs and do not respond at the same moment. This is why Finwise checks overlaps, coverage gaps and exclusions that interact with each other.
