What is it?

Protection when a third party claims damages

It covers claims linked to your activity: bodily injury, property damage, consequential loss or pure financial loss depending on the policy.

Mandatory?

Depending on your profession, clients or mandates

It is not mandatory for all companies, but it may be required by law, an authority, a regulated profession, a tender or a client contract.

Key point

Business liability and professional liability do not cover the same thing

The first protects operations, premises, products or employees. The second mainly targets errors in services, advice or mandates.

  1. By trade Extensions Worldwide, subcontractors, products
  2. Parameter Sum insured Limit suited to client risk
  3. Base Professional fault Financial loss caused to the client

Essential as soon as you advise or deliver a service.

What is professional liability insurance for?

An advisory error, missed deadline, poorly executed service or planning defect can create a major claim. Professional liability insurance applies when your activity causes damage to a client, partner, supplier or another third party.

The most sensitive concept is pure financial loss: a financial loss without prior bodily injury or property damage. This is typically the risk faced by consultants, fiduciaries, architects, engineers, developers, agencies, medical professions, experts and self-employed people who sell expertise.

Operations / business liabilityDaily activity
A client falls on your premises, an employee damages property, a product causes damage, or an installation injures a third party.
Premises, products, works, entrusted vehicles, worked-on property, subcontractors and territories.
Professional liabilityIntellectual or technical service
Incorrect advice, wrong calculation, disputed diagnosis, faulty planning, incomplete report, mandate delay.
Pure financial losses, declared activities, retroactivity, claims-made wording and discovery period.
Profession-specific extensionsSpecific risks
Entrusted or worked-on property, extended product liability, personality rights breach, crisis costs, subcontractor error.
Sub-limits, deductibles, exclusions, contractual obligations and tender requirements.

Professional liability works in two stages

Analyse the claim + Defend if it is unjustified + Indemnify if it is justified

This passive defence is often as important as indemnification. An SME therefore avoids financing experts, lawyers, negotiations and procedural costs alone when the claim is excessive or unfounded.

Is it mandatory?

Professional liability insurance is not mandatory for all activities in Switzerland. However, it may be required for certain regulated or sensitive professions, particularly in healthcare, law, auditing, finance, construction, engineering or specialised consulting.

Even when it is not imposed, it often becomes a commercial standard. Many clients, property managers, principals or tenders ask for proof of cover before signing.

Common pitfalls

Poorly configured liability cover can make you feel covered even though the claim falls outside the scope.

Undeclared activityA new service, country or undeclared sector can lead to refusal.
Pure financial loss missingStandard operations liability does not always cover advisory errors.
Entrusted or worked-on propertyItems you repair, transport or transform often require an extension.
Poorly coordinated cyber coverLes fuites de données et incidents numériques doivent être alignés avec votre cyberassurance.

I already have this policy. How can I cancel or change insurer?

Before switching, check the expiry date, cancellation period, declared activities, ongoing claims and above all the time validity. In claims-made wording, when the claim is made can matter as much as the date of the error. Retroactivity and the discovery period must be carried over correctly.

How to choose the cover

The right cover starts from your real scenarios: mandate amount, value of entrusted property, consequence of an error, client dependence on your service, subcontracting, countries of operation and contractual requirements. A small deductible may feel reassuring, but the most important point remains the definition of insured activities and types of damage.
